1. Agreement to Terms

By downloading, installing or using MagicTales (the “App”), you agree to be bound by these Terms of Use (the “Terms”). If you do not agree, please do not use the App.

2. Who We Are

The App is provided by Painites.

3. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App strictly in accordance with these Terms. You may use the App for personal, non-commercial purposes unless explicitly stated otherwise.

4. User Accounts & Age Restrictions

  • To use certain features you may be required to register an account. You must provide accurate and complete information.

  • The App is intended for use by children under adult supervision. If you are under the age of [13/16 as per local law], you must have parental or guardian consent.

  • You are responsible for maintaining the confidentiality of your account credentials.

5. User Conduct

You agree not to:

  • Use the App in any way that violates applicable laws or regulations.

All intellectual property rights in the App, including but not limited to software, graphics, text, logos, story-creation templates, belong to us or our licensors. You acquire no rights other than the license to use as set out in Section 3.

7. User-Generated Content

  • The App may allow you (or your child) to create stories, text or other content (“User Content”). You retain ownership of your User Content.

  • By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, modify, publish and distribute such User Content in connection with the App’s operation and promotion.

  • We have the right (but not obligation) to monitor, refuse to post, or remove any User Content for any reason.

8. Payment & Subscriptions

If the App offers paid features, subscriptions or in-app purchases:

  • You agree to pay all fees as specified at the time you subscribe or purchase.

  • Payments may be handled by third-party payment providers; you agree to their terms.

  • Subscription fees are non-refundable except where required by law.

9. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for conduct that violates these Terms or is harmful to other users, the App, or us. Upon termination, the licence granted in Section 3 ends and you must stop using the App.

10. Disclaimer of Warranties

The App is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, including but not limited to fitness for a particular purpose, non-infringement or uninterrupted access.

11. Limitation of Liability

To the fullest extent permitted by law, neither we nor our officers, directors, employees or agents will be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the App. Our total aggregate liability is limited to the amount you paid (if any) for the App.

12. Governing Law & Dispute Resolution

These Terms will be governed by the laws of [Your State/Country]. You agree to the exclusive jurisdiction of the courts in [Your City, State/Country] for any disputes arising under or in connection with these Terms.

13. Changes to Terms

We may modify these Terms from time to time. We will notify you of significant changes by posting a notice in the App or via email. Your continued use after changes means you accept the new Terms.
